Position
Benjamin Grzimek is a Partner in Fieldfisher´s Dusseldorf office and advises on all matters of Patent Law.
The focus of his practice is on advising and representing companies in patent infringement cases. His clients include small and medium-sized enterprises as well as global corporations from the pharmaceutical, medical technology, telecommunications, consumer electronics, mechanical engineering and other industries.
He has particular experience in assisting and coordinating cross-border disputes, both in the strategic preparation and implementation of patent enforcement measures and in defending against such attacks. He is therefore familiar with the basic features of the essential legal and other frameworks for patent infringement proceedings in more than a dozen countries.
He has also gained experience in patent and licensing arbitration proceedings, both as party representative and as arbitrator.
He has particular experience in the area of disputes concerning standard-essential patents. In more than 50 cases, he has advised patent owners and defendant companies on the specific patent, procedural and antitrust aspects of such disputes, in particular on the factual and legal circumstances giving rise to a possible compulsory licence defence (FRAND defence).
