Highlight-Mandate
- Defending the leading generative artificial intelligence company, OpenAI, in several actions brought by rightsholders who claim that OpenAI violated the Copyright Act.
- Defending Google against copyright and trademark claims brought in the Southern District of New York by four major educational publishers – Cengage, Macmillan, Elsevier, and McGraw Hill – alleging that Google promotes websites selling unauthorized and infringing copies of the plaintiffs’ works through its shopping ads.
- Representing Spotify in a lawsuit filed in the Southern District of New York by the Mechanical Licensing Collective. The issue in this lawsuit is whether Spotify Premium is a “Bundled Subscription Offering”, as that affects how much Spotify must pay in mechanical royalties. In the first lawsuit of this kind, the MLC alleges that Premium is not a Bundled Subscription Offering and that, accordingly, Spotify is underpaying royalties.
